TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFINITY WAVE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR ACCESS TO THE SITE IN THE TWELVE MONTHS BEFORE THE CLAIM (TYPICALLY ZERO FOR PUBLIC MARKETING USE) OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.

You will defend, indemnify, and hold harmless Infinity Wave and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or violation of third-party rights, except to the extent caused by our willful misconduct.

These Terms are governed by the laws applicable in Pakistan, excluding conflict-of-law rules that would apply another jurisdiction’s laws.

Courts located in Lahore, Pakistan will have exclusive jurisdiction over disputes arising from these Terms or the Site, subject to mandatory consumer protections where you reside that cannot be waived.

We may modify these Terms by posting an updated version on the Site and revising the Effective date. Continued use after changes constitutes acceptance where permitted by law. If you do not agree, stop using the Site.
